ProductWho is a mobile application that allows users to scan product barcodes and view information about brand ownership, parent companies, and related brands. The App provides:
- Barcode scanning functionality
- Brand and company information
- Links to external resources (Wikipedia)
- Optional premium features (ProductWho Pro)
3. Use of the App
3.1 Permitted Use
You may use ProductWho for personal, non-commercial purposes to:
- Scan product barcodes
- View brand ownership information
- Share information with others
3.2 Prohibited Use
You agree NOT to:
- Use the App for any illegal purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices or labels
- Use automated systems or bots to access the App
- Interfere with or disrupt the App's functionality
- Use the App to collect data for commercial purposes
- Redistribute, sell, or sublicense the App
4. Intellectual Property
4.1 Our Content
The App, including its design, features, code, and content, is owned by ProductWho and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal purposes.
4.2 Third-Party Content
Brand names, logos, and trademarks displayed in the App are the property of their respective owners. ProductWho is not affiliated with, endorsed by, or sponsored by any of the brands or companies shown.
4.3 Wikipedia Content
Some information in the App is sourced from or links to Wikipedia. Wikipedia content is licensed under Creative Commons Attribution-ShareAlike (CC BY-SA) licenses.
5. Accuracy of Information
5.1 Information Provided "As Is"
Brand ownership information is provided for informational purposes only. While we strive for accuracy:
- Corporate structures change over time
- Ownership information may be incomplete or outdated
- We do not guarantee the accuracy of any information
5.2 Not Professional Advice
6. ProductWho Pro (Premium Features)
6.1 Purchase
ProductWho Pro is a one-time in-app purchase that unlocks additional features. Purchases are processed by Google Play or Apple App Store.
6.2 Features
Pro features include:
- Scan history
- Export to CSV
- Ad-free experience
6.3 Refunds
Refund policies are governed by Google Play or Apple App Store terms. Contact the respective store for refund requests.
7. Advertisements
The free version of ProductWho displays advertisements provided by third-party ad networks (Google AdMob). We are not responsible for the content of third-party advertisements.
8. Privacy
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to our collection and use of information as described in the Privacy Policy.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS OF INFORMATION
We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App is free of viruses or harmful components.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODUCTWHO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR PRODUCTWHO PRO, OR $10, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless ProductWho, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
12. Changes to Terms
We may modify these Terms at any time. Changes will be effective when posted. Your continued use of the App after changes constitutes acceptance of the modified Terms.
13. Termination
You may stop using the App and delete it at any time. We may terminate or suspend your access to the App at any time, without notice, for any reason, including violation of these Terms.
14. General Provisions
- Governing Law: These Terms are governed by the laws of the United States.
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and ProductWho.
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
